General Terms and Conditions

Prices: Prices can fluctuate and are subject to price changes by our suppliers. The current price of an article you receive when ordering via our shopping cart. Tangodanza is obligated to accept the order of the customer on the conditions of the website. In the case of typing, printing and calculation errors on the website, Tangodanza is entitled to resign. All prices are listed inclusive of taxes. For your order, a flat shipping and packaging fee will be charged. For subscribers of the magazine Tangodanza, this shipping and packaging fee is canceled if the order value excels a fixed value. The amount of the prices can be found in the shipping costs overview. Please note that the order value is reduced by a return. We reserve the right to recalculate the shipping fee.

Payment: You can choose between the following payment methods for your orders:
A. Invoice: For customers residing in Germany we offer the purchase by invoice. The ordered goods will be sent together with an invoice. The currency of the payment has to be Euro. You have to ensure that the payment in full for the issued invoice is received by us. Please note that you have entered into a contractual relationship with us. We have provided for the receipt of payment a period of 14 days from the date of invoice. We reserve the right to remind you of any unpaid invoices after a period of 30 days and to remind you 10 days later, whereby we will charge you a dunning fee of 3.50 Euro for the reminder.
B. Direct Debit: For holders of bank accounts in one of the 28 EU member states, Switzerland, Iceland, Liechtenstein, Norway or Monaco, we offer direct debit payments (SEPA Basic Mandate / SEPA Company Mandate). The direct debit is collected by the Sparkassen-Finanzgruppe GiroSolution GmbH, Hauptstraße 27, D-88699 Frickingen. In the event that the payment collected by direct debit should fail, we will usually make immediate investigations and will attempt to contact you. For the expenses incurred in connection with chargebacks on the basis of incorrect bank or account information, uncovered or extinguished account or unjustified objection without prior consultation, we charge the costs charged by the banks, plus a fee of 5.- Euro. If you do not agree to a charge on your account and wish to object, please try to avoid costs and contact us directly before submitting an objection to clarify the problem.
C. Credit Card: For Visa and Mastercard holders, we offer payment by credit card. Payment is handled by the Sparkassen-Finanzgruppe GiroSolution GmbH, Hauptstraße 27, D-88699 Frickingen.
D. Paydirekt: You can pay with the secure German online payment system PayDirekt if you have an account with a bank or savings bank based in Germany. (www.paydirekt.de) The payment is handled by the Sparkassen-Finanzgruppe GiroSolution GmbH, Hauptstraße 27, D-88699 Frickingen.
E. PayPal: With the secure online payment system Paypal you can transfer money from 190 countries with just a few clicks via credit card, giropay, direct debit or PayPal credit. Paying with PayPal is always free for you as a buyer. The amount will be credited to us by PayPal without sending us information about your bank or credit card details.

Delivery: Your order will be executed within 3 days. We reserve the right to delay the delivery of a shipment by up to 10 working days, if we can see that items currently not in stock will arrive here within this timeframe. Should we not be able to send the ordered item within 4 weeks due to delays in delivery or product cancellations of our suppliers, you will receive a separate message about this and your order will be deleted on request in our system.

Withdrawal: Under the German Distance Selling Act you have a right of withdrawal. The following right of withdrawal does not apply to sealed goods (audio, video recordings, sealed books) if you open or damage the sealed packaging (unsealing) and on delivery of goods that are made with customer specifications or clearly produced to personal needs or the due to their nature are not suitable for return. You are no longer bound to your order if you withdraw within a period of two weeks after receipt of the goods. The revocation does not have to contain any reasons and must be made in written form or by returning the item. To meet deadline timely send it to:

In the case of a withdrawal, we will refund any payments already made upon the return of the goods. You are bound to return the goods at our risk, unless you have done so together with the letter of revocation. You have to bear the costs of the return, if the delivered item is the same as ordered and if the price of the item to be returned does not exceed an amount of 40 Euro or if at a higher price of the item at the time of the withdrawal the payment is still not executed as agreed. In addition, we bear the cost of the return and ask to not send us unfree shipments, as this is associated with significant additional costs (12 € penalty postage) for us (we refunded postage paid back to you). When returning damaged or used goods Tangodanza is entitled to assert claims for compensation (§ 361a II BGB). This does not apply if the condition of the item is solely based to its examination - as it would have been possible for you in a shop, for example. For a condition caused by the intended use of the item, you do not have to pay any compensation.

Delay of payment: Should you be in delay with your payments, we reserve the right to charge you for the delay with 5% default charges as it is the respective base default charge rate announced by the Deutsche Bundesbank (www.bundesbank.de). You remain entitled to prove that we suffered no or only a minor damage caused by the delay.

Reservation of title: Until full payment, the delivered goods remain the property of Tangodanza. Until then, you must treat the goods with care and immediately report any damage. In case of a delay of payment we are entitled to withdraw from the contract and to reclaim the goods. The costs of the return in case of a delay of payment (after expiry of the withdrawal period) are at your expense and must be refunded if you have not already carried them yourself.

Liability for defects: If there is a defect in the purchased goods for which Tangodanza is responsible, the customer may demand compensation by supplementary performance (removal of defects or replacement). If Tangodanza is unable or unwilling to remedy the defect due to disproportionality or if it is delayed beyond reasonable deadlines for reasons for which Tangodanza is responsible or if the compensation fails in any other way, the purchaser shall be entitled to a corresponding reduction of the price or to withdraw from the contract and claim compensation.

Data protection: We store and use your data only for the execution of the contractual relationship (if necessary with affiliated companies and for the credit check). Of course, your information will be kept protected. For detailed information please cosult our privacy police.

Place of jurisdiction: Place of the performance of jurisdiction for merchants, legal entities under public law, legal persons and private individuals for all mutual obligations due from the contract, including possible restitution claims shall take place in Bielefeld.

Applicable law: The law of the Federal Republic of Germany applies excluding the UN Convention on Contracts for the International Sale of Goods.
